Health policy attorneys to present on 1115 and 1332 waivers at American Association of Health and Human Services Attorneys conference

UMass Medical School Health policy attorneys will present on 1115 and 1332 waivers at the American Association of Health and Human Services Attorneys (AAHHSA) annual national conference in Norfolk, Virginia.

A team from the Center for Health Law and Economics will present “Waiver World: A Guided Tour of 1115 and 1332 Waivers,” from 8:30 to 10 a.m. on Nov. 15. The presenters are Jean C. Sullivan, JD, associate vice chancellor and Center director; Marybeth McCaffrey, JD, principal; Josh Krintzman, JD, senior consultant; and Rachel Gershon, JD, MPH, associate.

Under Section 1115 of the Social Security Act, states can pursue waivers to implement pilot or demonstration projects affecting many programs, including Medicaid.  Under the Affordable Care Act, Section 1332 allows states to pursue federal waivers for innovation strategies that will expand access to high-quality, affordable health care.  

The team will explain and discuss spending and waiver authority and the legal considerations that may arise.  It will highlight ways that states have used waiver authority and review the limitations and new responsibilities that come with waivers. 

The Center specializes in health coverage and access to care options, delivery system reform, alternative payment methods, health program financing, and legislative reform. Services include system-wide approaches to the design, development, and analysis of health care improvement efforts and reform implementation strategies.
